Terms of Service
Effective date: October 16, 2026
Operator: Cachepics LLC (“we,” “us,” “our”), a Wisconsin limited liability company
Contact: support@cacheshots.com
1. Agreement to these Terms
By creating an account or using the cache•shots mobile application (the “App”) and our related printing and fulfillment services (together, the “Service”), you agree to these Terms of Service (“Terms”) and to our Privacy Policy. If you do not agree, do not use the Service.
You accept these Terms when you tap to continue at account creation. We may update these Terms; material changes will be notified in-App or by email, and continued use after the effective date constitutes acceptance. The App is offered through the Apple App Store and Google Play, and your download and use of the App from a given store is also subject to that store’s applicable terms.
2. Eligibility
You must be at least 18 years old. By using the Service you represent that you meet this requirement and that the information you provide is accurate. The Service is currently offered only for shipping addresses within the United States.
3. What cache•shots is
cache•shots is a “disposable camera” experience. Key behaviors you acknowledge and accept:
- Live capture only. You can only photograph what you shoot live in the App. There is no import from your photo library.
- No review after capture. By design, you do not see a photo after you take it – this mimics film. There is a live viewfinder (preview) but no post-capture review or instant gallery of your shots.
- Physical prints. Photos are printed as physical 4 x 6 prints by our third-party print and fulfillment provider and mailed to you.
- Digital negatives. Digital copies of your photos become available to you in the App after you confirm delivery of your prints. Digital negatives remain available for a limited time after you confirm delivery of your prints (currently 6 months), after which they may be permanently deleted from our systems. If you confirmed delivery while our placeholder Terms and Privacy Policy stated a 12-month period, you keep a 12-month availability period for the negatives associated with those confirmed deliveries. For an event, if the host never confirms delivery of the event’s prints, the event’s digital negatives are deleted 12 months after the event ends. For a roll, if you never confirm delivery, its digital negatives are deleted 12 months after it ships. We encourage you to save any photos you want to keep before then. Your physical prints are yours to keep regardless.
- Events. You may host or join an “event album.” Shots taken by all participants in an event are compiled into the host’s roll; the host pays to fulfill the event roll and receives the physical prints of all participants’ shots. Participants do not view each other’s photos in the App.
We may change, suspend, or discontinue any part of the Service at any time.
4. Accounts
You sign in by email one-time passcode and choose a public handle that is printed on your photos. You are responsible for activity under your account and for keeping access to your email secure. During limited-availability periods, account creation may require an invite code, an invite link, or an event code. Handles and event names are subject to our content rules (Section 5) and may be rejected or changed if they violate them. Because your handle is printed on physical prints, your handle is permanently retired if your account is deleted and cannot be claimed or reused by any other user. Once set, a handle can only be changed by us. A handle that is replaced is permanently retired in the same way.
5. Acceptable use and prohibited content
You are solely responsible for the content you capture, submit, print, and share through the Service. You agree not to use the Service to create, upload, or transmit content that:
- depicts, or constitutes, child sexual abuse material (CSAM) or any sexual content involving minors – this is strictly prohibited and reported as required by law (see Section 8);
- is sexually explicit, pornographic, or obscene;
- depicts or promotes violence, gore, or harm to others;
- is unlawful, infringes others’ intellectual property or privacy rights, or is defamatory, harassing, or hateful;
- contains another person’s likeness without the consent required by law, including in any event you host or join;
- contains profane, hateful, or abusive text in a handle or event name.
You also agree not to abuse, reverse-engineer, overload or attempt to circumvent the Service, its rate limits, or its safety systems.
6. Content moderation and enforcement
To keep the Service safe and lawful, you acknowledge and agree that:
- We use automated systems to screen the photos and text you submit. When you upload a photo, it is scanned against known child sexual abuse material (CSAM) hash databases using Microsoft PhotoDNA before further processing, and photos are screened for other prohibited content using Google Cloud Vision before printing. We also screen handles and event names for prohibited text.
- We may withhold from printing any image our systems flag as prohibited. When a shot is withheld, we will not print it, and we refund that shot’s share of the amount you paid for the order. For a free or discounted roll, that amount may be $0. A placeholder is shown in your digital gallery in place of a withheld image.
- We may remove content, refuse service, and suspend or terminate accounts that violate these Terms, at our discretion.
- Automated screening is not perfect; it may withhold permitted content or, in rare cases, fail to catch prohibited content. Our screening does not make us responsible for user content.
7. Your content and license to us
You retain ownership of the photos you create with the Service. To operate the Service, you grant Cachepics LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, screen, reproduce, and print your content solely for the purposes of providing the Service to you (including fulfilling and shipping your prints, providing your digital negatives, operating event albums, and performing safety screening and legally required reporting). We do not sell your photos, and we do not use, or authorize our service providers to use, them to train artificial-intelligence or machine-learning models. This license ends when your content is deleted, except for copies we must retain to comply with law (see Section 8).
7A. Promotional use (opt-in only)
Separately from the operational license above, you may opt in to let us use your photos to promote the Service, for example on our social media (including Instagram @cache.shots), in advertisements, on our website, and in other marketing.
- Off by default. We do not use any of your photos for promotion unless you turn this on in your account settings. Your choice is recorded.
- Solo rolls only. Only photos from your own solo rolls are ever eligible. Event photos are never eligible for promotional use, because they may include other people who have not consented.
- What you grant. While you are opted in, you grant Cachepics LLC a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, edit, display, and distribute the eligible photos for promotional and marketing purposes, with or without your handle, and without further notice or payment.
- When it applies. Only photos you take while opted in are eligible. Turning the setting off later removes your photos from our promotional pool going forward.
- Turning it off (revocation). You can opt out at any time. When you do, we will make no new promotional use of your photos and remove them from the promotional pool. However, promotional uses already made while you were opted in may continue, and we are not obligated to remove, recall, or stop distributing content already published (for example, an existing social post or a printed or placed advertisement). We keep records of consent and of each promotional use.
- No compensation. Promotional use is voluntary and unpaid.
7B. Third-party notices and open-source attribution
The Service and App include or are adapted from third-party and open-source materials that remain the property of their respective owners and are provided subject to their own license terms. The color look and print-look presets used in the App are derived from the RawTherapee Film Simulation Collection, which is licensed under the Creative Commons Attribution-ShareAlike 4.0 International License (CC BY-SA 4.0), https://creativecommons.org/licenses/by-sa/4.0/. We have modified the original material. Our derived look table is made available under the same CC BY-SA 4.0 license on request at support@cacheshots.com. The original material and any adaptations are provided “as is,” without warranties, to the fullest extent permitted by that license.
This ShareAlike obligation applies only to the adapted look table—the color-rendering and preset data derived from the RawTherapee Film Simulation Collection. It is not an offer or license to access, and does not require us to disclose, the App, the Service, or our servers, backend, databases, server functions, or any other software, source code, APIs, or systems, all of which remain proprietary and are licensed only as expressly stated in these Terms and the EULA.
8. Illegal content and legal reporting
We have zero tolerance for CSAM. Where our systems or staff identify apparent CSAM, we will, consistent with applicable law: preserve the relevant content and records, suspend the responsible account, and report to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement as required by 18 U.S.C. § 2258A and related law. Enforcement and reporting are scoped to the responsible user. For investigative and legal reasons, we may not disclose the specific reason for a suspension.
9. Payments, pricing, and shipping
- Prints and related physical goods are sold by us. Checkout is hosted by our third-party payment processor, Stripe, and by purchasing you authorize us and Stripe to charge your selected payment method for the prints, shipping, and applicable taxes shown at checkout. We do not receive or store your full payment-card number.
- These are physical goods, no in-app digital purchase is required to use core features.
- Sales tax is calculated and collected where we are required to collect it.
- Shipping is currently U.S.-only; delivery times are estimates, not guarantees.
- A free first roll may be offered to eligible new users (shipping may still be charged). Eligibility and availability are determined by us and may change or end at any time.
10. Refunds, defects, and confirming receipt
Personalized goods – sales final. cache•shots prints are personalized physical products made to order. Once an order is submitted for fulfillment, all sales are final and orders generally cannot be changed or cancelled, except as set out below or as required by applicable consumer protection law (which this section does not limit).
Confirming receipt in the app. When your prints arrive, you confirm receipt in the app by tapping to confirm and typing a short confirmation. We record the date and time of that confirmation. Confirming receipt (a) unlocks your free digital negatives, and (b) starts the time window for reporting any defect under this section. Please inspect your prints before confirming receipt.
Withheld shots. Shots withheld by content screening are automatically refunded their share of the amount paid for the order, as described in Section 6, no request needed.
Defective or incorrect prints. If your prints arrive damaged, misprinted, or materially different from what was ordered, or if there is a fulfillment error (wrong items, wrong quantity), contact support@cacheshots.com within the window below and include photos of the issue and your order details. For verified defects or errors, our sole remedy to you, at our option, is a reprint or a refund of the affected items. The reporting window is:
- within 30 days after you confirm receipt in the app; or
- if you do not confirm receipt, within 45 days after the order is shipped (dispatched). We recommend confirming receipt promptly when your prints arrive – it also unlocks your digital negatives.
Non-delivery / lost shipments. If your order has not arrived within 30 days after it is shipped (dispatched), contact support@cacheshots.com so we can investigate with the carrier and reprint or refund as appropriate.
No defect reports after the window. Because these are personalized goods that must be inspected promptly, defect and non-delivery claims made after the applicable window above may not be eligible for a remedy, except where required by law.
11. Events
If you host an event, you are responsible for the content compiled into your roll and for having any consents required to print and possess photos of the people depicted. Participants are responsible for the shots they contribute. We may withhold prohibited shots from an event roll and refund the host per Section 6, and we may take account action against the responsible participant only.
12. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or applicable law, or to protect the Service, other users, or third parties. Upon suspension you may lose access to the App and to your digital negatives.
You may stop using the Service at any time. You can delete your account at any time from within the App, or contact support@cacheshots.com to request deletion. In addition, if your account remains inactive for an extended period (currently 6 months), we may delete it after emailing you an advance warning; signing in again cancels the deletion. Account and data deletion is subject to records we must retain by law and does not apply to accounts under legal hold. Separately, your digital negatives remain available only for a limited time after you confirm delivery (Section 3). See our Privacy Policy for full details on data retention.
When you delete your account, we delete your profile, your handle, your rolls, and the associated digital negatives, except as follows and except for records we must retain by law. We keep a minimal order record for tax, refund, accounting, and dispute purposes, and your promotional-use consent record. Photos you contributed to another user’s event remain part of that host’s event album and prints, but our records no longer show who took them; where your handle was printed into a bordered print, it remains on the host’s copy and negatives until those negatives expire under Section 3. When a host deletes their account, the host’s events are deleted in the same way as the host’s own rolls, and orders already in production will still be produced and shipped. If you delete your account while an order is in production or in transit, we close your account immediately and complete the deletion 30 days after the order ships (and no later than 90 days after your request), so a lost or damaged shipment can still be reprinted.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that prints will exactly match what you saw in the viewfinder.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR US$50.
15. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses arising out of content you submit or your violation of these Terms or of any law or third-party right.
16. Governing law and disputes
16.1 Governing law. These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Wisconsin and applicable U.S. federal law, without regard to conflict-of-laws rules. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
16.2 Informal resolution first. Before filing any formal claim, you agree to first contact us at support@cacheshots.com and give us 30 days to resolve the dispute informally. Many issues (especially print defects and orders) can be resolved this way.
16.3 Venue. You agree that any dispute not resolved informally will be brought exclusively in the state or federal courts located in Milwaukee County, Wisconsin, and you consent to the personal jurisdiction of those courts. This does not prevent either party from bringing a qualifying individual claim in small-claims court.
17. Changes
We may revise these Terms from time to time. The “Effective date” reflects the latest version. Material changes will be communicated in-App or by email.
17A. Accessibility
We are committed to making the cache•shots app and Service accessible and strive to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you need an accommodation or encounter an accessibility barrier, please contact us at support@cacheshots.com.
