Operator: Cachepics LLC (“we,” “us,” “our”)
Cachepics LLC respects the intellectual property of others. This page explains how to tell us if you believe material stored through cache•shots infringes your copyright, and how to respond if your material was removed. It sits alongside our Terms of Service and does not change them.
1. Our designated agent
Send notices of claimed copyright infringement to our designated agent:
Copyright Agent, Cachepics LLC, c/o Cogency Global Inc., 100 Wilburn Road, Suite 100, Sun Prairie, WI 53590
- Telephone: (608) 285-2157
- Email: support@cacheshots.com
Our agent is registered with the U.S. Copyright Office in its DMCA Designated Agent Directory (registration number DMCA-1084204).
2. What to include in a notice
Under the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), a notice must include:
- a physical or electronic signature of the copyright owner or of a person authorized to act on the owner’s behalf;
- identification of the copyrighted work you believe has been infringed;
- identification of the material you believe is infringing, with enough information for us to find it (for example, the account handle, the roll or event, and the shot number);
- your name, mailing address, telephone number, and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act on the owner’s behalf.
If a notice is incomplete, we may contact you for the missing information before acting on it.
3. Counter-notification
If material you stored was removed because of a notice and you believe it was removed by mistake or misidentification, you may send a counter-notification to our designated agent. Under 17 U.S.C. § 512(g)(3), it must include:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before it was removed;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification; and
- your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which Cachepics LLC may be found), and that you will accept service of process from the person who provided the original notice or that person’s agent.
When we remove or disable material in response to a notice, we will take reasonable steps to tell the user who stored it. If we receive a valid counter-notification, we will send a copy to the person who submitted the original notice and tell them that we will restore the material in 10 business days. We will restore it no sooner than 10 and no later than 14 business days after we receive the counter-notification, unless our designated agent first receives notice that the person who submitted the original notice has filed a court action seeking to restrain the user from the claimed infringing activity.
4. Repeat infringers
In appropriate circumstances, we will terminate the accounts of users who repeatedly infringe the copyrights of others, consistent with our Terms of Service.
5. Misrepresentation
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages.
